A Fenton-based home healthcare provider has been ordered to pay more than $93,000 in back overtime pay and damages to 23 workers.
MLive.com reports that Independent Home Care of Michigan LLC, and its owners Mary Clark, and her daughter, Kathryn Flick, failed to pay overtime between Jan. 23, 2018, and June 1, 2019. That was a requirement of the Home Health Care Final Rule which went into effect in 2015 and mandating km staffing agencies to pay overtime to companion services workers after 40 hours.
The judgment, in which $93,331 must be paid to companion workers, including $46,665 in back wages, came from federal Judge Victoria A. Roberts after a two-day bench trial last month.
Investigators with the U.S. Department of Labor Wage and Hour Division also determined the company violated the Fair Labor Standards Act when it failed to keep accurate records of hours worked and rates of pay.
