The victim’s mother likened the pain her family endured at the hands of the defendant to solving a “puzzle” involving recollections of how the offender might have raped a thirteen-year-old.
According to a Spanish-language letter submitted to Kern County Superior Court by the victim’s mother, Javier Chavez, 61, sexually molested her daughter for many years while she was a teenager, and as a result, the victim does not lead a peaceful life. All of Chavez’s children have been affected by the trauma, according to the mother’s letter.
A victim impact statement was read aloud to Judge John Brownlee during Chavez’s sentence Thursday in Kern County Superior Court by a Spanish interpreter. The mother wrote, “Even though he’s in prison, we continue to live in fear and trauma.” She was present at the sentencing hearing.
There were four counts against Chavez: three of sodomy by force on a minor 14 or older, two of lewd or lascivious acts with a minor under 14, one of forceful oral copulation with a minor older than 14, and one of making criminal threats. Chavez received a 43-year and eight-month prison sentence for these offenses.

The girl was 13 years old when Chavez started sexually touching her, according to the Kern County District Attorney’s Office. Chavez escalated his violent behavior and started sodomizing the boy between the ages of 14 and 17. Chavez screamed and physically intimidated the victim as the sexual abuse was happening.
Even if Chavez were to be released from prison after serving 75% of his time, he would still be 98 years old, according to Brownlee, who stated his belief in Chavez “absolutely does not deserve” any early release.
As prosecutor Michael Morea read aloud from the victim’s family’s letters to the judge before Chavez’s sentence on Thursday, several members of the family broke down in tears. In a letter submitted to the court, one of the victim’s sisters expressed her worst anxiety upon receiving the news about Chavez.
The victim’s sister recalled that her brother repeatedly apologized to her before urging her to contact the authorities.
A different sister expressed her disapproval of Chavez’s behavior, calling it “monstrous” and saying that her sister’s ordeal has caused her to reconsider her aspirations of being a mother in the future.
